Effective immediately upon enactment, Montgomery County residents with a will can file it with the county probate judge. The file and related papers are confidential; before the will-maker dies, only the filer, their legal representative, or their attorney can access them. A public docket records the will and its deposit and withdrawal dates. The judge may charge a reasonable fee for each will filed; the law sets no amount. Filing does not prevent changes before death or revocation by making a later will.
