Beginning October 1, 2026, Alabama counties can use local laws to change constable numbers, service areas, and office vacancy rules. The default remains one constable per election precinct, elected for a four-year term. By default, constables leave office when they move out of the precinct that elected them, or as otherwise required by law. Counties can change those vacancy rules through local laws. Counties also keep their power to abolish constable offices through local laws. Probate judges must notify the Governor whenever any constable office becomes vacant. The law adds no funding, fee changes, or direct household payments.
