Bill Overview

Analyzed Economic Effects

5 provisions identified: 1 benefits, 2 costs, 2 mixed.

Release rights for Lawrence County defendants

Beginning October 1, 2026, Lawrence County defendants charged with non-capital, bailable offenses are entitled to release before trial. Release is on a promise to appear in court or an appearance bond. Exceptions apply when a judge finds release cannot reasonably assure court appearance or poses a real, present public danger. The judge may then require a bond with a 10% deposit or other reasonable conditions, including returning to custody after specified hours. The law also emphasizes avoiding needless detention and equal treatment regardless of financial or social status.

County keeps part of defendants' bond deposits

Beginning October 1, 2026, the clerk must send 10% of a defendant's appearance-bond deposit to the county commission. This transfer must happen within 30 days of the deposit, for distribution to the county corrections and court services fund. The remaining 90% returns to the defendant when charges are dismissed or a sentence is imposed after conviction. Money collected under the release rules goes into that fund unless general law directs otherwise.

Old county work-release law is repealed

Beginning October 1, 2026, the law repeals the 1979 act that created Lawrence County's rehabilitation board and work-release program. This removes the legal basis for that board and program. The repeal concerns that older framework, not all work-release programs authorized under the county corrections system.

County towns can join corrections programs

Beginning October 1, 2026, any Lawrence County municipality can choose to join the county corrections and court services programs. It must adopt a resolution and send a certified copy to the Community Corrections and Court Services Commission. Participating municipalities must contribute revenue from authorized work-release programs to the county fund. Participation starts on the first day of the fiscal quarter following delivery of the resolution.

County corrections money gets spending rules

Beginning October 1, 2026, Lawrence County's Community Corrections and Court Services Fund must support the programs covered by this law. Allowed uses include eligibility investigations and studies, related salaries and expenses, administration, job transportation, and matching federal or state grants. The fund also supports treatment, rehabilitation, education, intervention, and pretrial diversion programs. At fiscal year-end, surplus money may move to the county General Fund. A majority of the commission must decide at a duly convened meeting that the amount exceeds program needs.
