Beginning June 1, 2026, Mobile County’s elected probate judge has longer authority to appoint temporary judges for court workload needs. Reasons include crowded calendars, complex issues, lengthy trials, or caseload management. The law removes the cutoff tied to the first regular legislative session after a successor takes office. Appointment authority ends when a second probate judge is authorized and takes office. Existing limits remain: each appointment lasts up to 90 days, with renewals allowed, but service cannot exceed 100 days per fiscal year. The elected judge must immediately resume office after filing a certificate with the circuit clerk stating the judge is no longer incompetent; the temporary judge’s authority then ends. That certificate no longer needs to address incapacity, absence, sickness, or other disqualification.
