Higher fees for Alabama funeral businesses

Beginning June 1, 2026, Alabama's funeral services board can set higher fees for businesses selling prepaid funeral or cemetery contracts. Certificate applications, annual renewals, branch registrations, annual branch renewals, and certificate transfers each have a $500 cap. Previous caps were $198 for applications and branch registrations, $99 for renewals, and $132 for transfers. The board can also charge funeral establishments up to $30 per final disposition involving funeral arrangements or other regulated services. The board sets actual fees; the law does not say whether businesses pass these costs on to families.

Higher fees for prepaid funeral agents

Beginning June 1, 2026, Alabama's funeral services board can charge prepaid funeral and cemetery sales agents higher registration fees. Initial applications and annual renewals each have a $200 cap, up from $33 each. The board sets the actual amounts.

More reporting for prepaid funeral businesses

Beginning June 1, 2026, Alabama certificate holders must file a full, accurate statement of the prior calendar year's prepaid funeral and cemetery activities. This expands reporting beyond activities of trusts they established. Holders must use the funeral services board's form and meet its yearly deadline. They must also file contract activity reports at least annually, using the board's required form or format. The board sets report frequency and can require multiple reports without waiting for two reporting defaults.
