Alabama shifts oversight of behavior analysts

Effective upon enactment, Alabama keeps behavior analyst licensing but moves oversight to the Department of Mental Health. The former board becomes an advisory council; the department handles rules, licenses, and complaints. The commissioner has enforcement and suspension powers, while most discipline requires the council’s recommendation. All program receipts go into the renamed Advisory Council Fund to administer the licensing law. Spending must follow state budgeting and allotment rules and stay within approved appropriations; this funding provision sets no new fee.

Behavior analyst board loses sunset reviews

The law removes the former behavior analyst licensing board from Alabama’s Sunset Law. This ends that law’s requirement for periodic review of the board. The repeal names no replacement review process.
