Beginning June 1, 2026, Alabama makes nursing facility assessments permanent, removing their August 31, 2028, end date. The surcharge stays $43.75 per bed monthly; the secondary supplemental assessment still requires the minimum appropriation specified in Act 2015-536. Medicaid uses nursing facility payment rules in place on May 1, 2026, with exceptions under Section 40-26B-26. Certain daily assessment adjustments use total resident days reported in facility Medicaid cost reports, removing wording that counted days regardless of who paid. Facilities keep paying these assessments, but Medicaid daily rates must include assessment costs, with payment ceilings adjusted to allow their recovery.
