Beginning October 1, 2026, the Marshall County Sheriff can use public or online auctions to sell recovered abandoned or stolen property. Eligible property must remain unclaimed for 12 consecutive months, and auctions must occur at least every six months. Perishable items follow a separate sale law. The law removes the cash-only requirement but does not name accepted payment methods. Sales go to the highest bidder, but the Sheriff can reject unreasonably low bids. Notice requires either newspaper publication once weekly for two successive weeks or courthouse posting for at least 20 days. The first newspaper notice must also appear at least 20 days before the sale. The Sheriff must record each auction sale and the amount received in the storage record book. A sale can continue even when no bidders are present.
Beginning October 1, 2026, the Marshall County Sheriff can sell recovered firearms only to federally licensed gun dealers. A dealer's license must be current on the sale date. The Sheriff must establish a dealer notification process, and the dealer submitting the highest sealed bid gets the firearm. After recovery, maintenance, and sale costs are paid, the remaining money goes to the Marshall County Sheriff's Office.
Beginning October 1, 2026, the Marshall County Sheriff must permanently record recovered abandoned or stolen firearms not governed by general-law disposal rules. Records must include the firearm's description, serial or identifying number if any, and recovery location. The Sheriff must make reasonable efforts to find owners, including notifying nearby counties' sheriff's offices. Unless another law provides otherwise, the Sheriff can sell or destroy firearms unclaimed within 12 months after recovery. The Sheriff can set a destruction process and spend necessary Sheriff's Office funds on it; no spending amount is set.
