School workers can share sick leave directly

Beginning with the 2027–2028 school year, covered education employees can donate sick leave directly to another employee for any reason. Donors and recipients can work for different education authorities. Each recipient can receive no more than 30 total directly donated days per academic school year. The days stay outside sick leave banks and do not need to be repaid. Education authorities without a sick leave bank must adopt procedures for direct donations.

School workers face catastrophic leave exclusions

Beginning July 1, 2026, catastrophic sick leave covers extended work absences caused by illness, injury, pregnancy, or childbirth-related medical conditions. Conditions related to the Public Education Employee Injury Compensation Program or paid parental leave are excluded. Employees with those conditions cannot use catastrophic sick leave under this section.

School leave donations grow, with new paperwork

Beginning July 1, 2026, the law removes the former 30-day cap on bank donations for one employee's catastrophic leave. This provision sets no replacement maximum. Employees cannot be required to appear before a bank committee or get its approval to donate or receive leave. Employees taking leave under this section must give their education authority a written plan for its intended use. These bank donations are separate from direct donations, which retain a 30-day annual recipient cap.

School worker sick leave coverage changes

Beginning July 1, 2026, the law changes which education employers fall under these sick leave rules. Local boards of education remain covered. The law adds the Alabama School of Cyber Technology and Engineering and the Alabama School of Healthcare Sciences. It removes earlier references to two-year postsecondary institutions and Alabama A&M University.

School workers get statewide leave bank rules

Beginning July 1, 2026, Alabama's State Board of Education must adopt a model sick leave policy and rules. It covers leave banks, loans, catastrophic leave, and direct donations. Bank membership requires an equal deposit of up to five earned sick days; loans serve members who have exhausted their leave. Bank committees implement the model, and members approve bank guidelines by secret ballot. Education authorities also approve guidelines and handle bank accounting and discretionary functions. The State Board must create standard forms for banks, transfers between banks, and direct donations; authorities may use them.
