Alabama emergency child custody becomes final
Beginning October 1, 2026, Alabama temporary emergency child custody orders become final six months after entry when both conditions apply: no earlier custody order is enforceable, and no custody case begins during those six months in a state with legal authority. Alabama retains emergency authority for children present in the state who face abandonment, mistreatment, abuse, or an emergency requiring protection. When an earlier enforceable order or a case in another state with authority exists, Alabama courts must set a temporary order's time limit. That order lasts until the other state issues an order within that period or the period ends. Alabama courts handling regular custody cases must immediately contact the other state's court when notified of its custody case or emergency order. The courts must address the emergency, protect the child and parties, and decide how long the temporary order lasts.
