Power contract safeguards for other Alabama customers

Beginning October 1, 2026, Alabama sets a public-interest test for large data center power contracts. Covered centers must need at least 150 megawatts of expected peak power on one parcel or adjoining parcels. They must also meet Alabama’s legal definition of a data processing center and operate only for data processing. Contracts meet the test when, over their term, they are expected to recover added service costs from the center and benefit other utility customers. Added costs include fuel and taxes. Contract terms address minimum length, upfront payments, security and collateral, and minimum payments. The Public Service Commission considers possible cost reductions for other customers, power-system efficiency gains, and local economic growth.
