Alabama agencies must plan public program reviews

Beginning October 1, 2026, agencies must prepare evaluation plans for new programs or major expansions funded through appropriations acts. Major expansions include funding increases of at least 25% over the prior fiscal year or significant changes in people served, delivery methods, or service areas. The Legislative Services Agency must identify covered programs within 30 days after the applicable session ends. Plans must explain goals, measures, data sources, benchmarks, and how results will be tested. Programs meeting commission criteria need a test of whether the program caused results, or an explanation of why that test is unsuitable. The commission must approve and publish plans before data analysis, publish evaluation standards, and post required agency reports. Agencies and their contractors must provide available materials needed for reviews and data collections requested by the director or commission staff. Evaluations must follow applicable federal privacy and data security requirements.

Alabama creates legislative service review department

Beginning October 1, 2026, Alabama’s service evaluation commission becomes a legislative department and takes over the prior commission’s staff, assets, records, and contracts. A new 12-member legislative committee oversees its work, appoints its director, and sets the director’s pay. A State Treasury fund holds appropriations, grants, and gifts for the commission. The commission can award grants to state agencies when funding is available. All commission spending requires legislative appropriation and state budget controls; the law sets no new funding amount or guaranteed grant awards.

Alabama lawmakers can tie spending to reviews

Beginning October 1, 2026, lawmakers can require specific program reviews through an appropriations act or another act. They can limit the share of program funds available until an acceptable evaluation plan is submitted. They can also set report deadlines, add questions or measures, and require later funding decisions to consider findings. These conditions apply only when lawmakers impose them in an act; this law sets no specific spending cap.
