People who bill for or receive payment for certain behavioral health services must keep required service and payment-rate records. This law makes knowingly failing to keep them a Class 1 misdemeanor. Knowingly failing to report that these records were destroyed is a Class 2 misdemeanor. The penalties apply when the state health system finds a sufficient basis to suspect related fraud and refers the investigation to a criminal justice agency.
