ASRS members who reach normal retirement eligibility can retire and keep their elected office. They can continue receiving retirement benefits, including in elected jobs beyond state offices subject to term limits. The choice is irrevocable and requires written acknowledgment. Retired officials earn no more service credit, cannot buy credit for elected work, and cannot get long-term disability benefits. A retiree with a covered nonelected job must leave it or cut hours below the active-member limit.
Beginning July 1, 2012, an ASRS employer pays an annual alternate contribution on the pay of certain retirees in active-like jobs. This applies when the retiree has reached normal retirement age or retired under the specified rule, and benefits are not suspended. The actuary sets the rate each year; it is at least 2% and capped by the lower of two employer-rate totals: contribution rates or past-service funding rates. Employers must report and pay, and late amounts accrue interest. No payment is required when the retiree fills a job held by an active member receiving contributions, though the employer may still pay. Beginning July 1, 2019, an employer can request a credit within 90 days after the fiscal year ends when the rate did not apply; ASRS refunds the amount if a credit cannot be used.
