Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 2 costs, 1 mixed.

Capped fees for home sales

Associations can charge up to $400 total for covered resale reports, lien information, and transfer or use services in one transaction. They can add up to $100 for rush work due within 72 hours, or up to $50 for an updated report requested at least 30 days after the original. Fees can be collected only at or after closing and charged once per transaction. Other related fees are barred, and an association that charges an unauthorized fee can face a penalty of up to $1,200.

Buyers must update associations after exempt deeds

When a recorded deed uses one of the specified state-law exemptions, the buyer must give the association ownership updates, including the new owner’s name, billing address, and phone number. Missing this information does not cancel the deed’s exemption.

Fewer legal options for disclosure mistakes

A buyer or seller harmed by a missing required disclosure or a materially false or misleading statement may seek legal or equitable relief only when the failure or statement was knowing or reckless. A court may award reasonable attorney fees.

More resale details for homebuyers

For communities with fewer than 50 units or properties, the seller must deliver resale information within 10 days after the offer is accepted. In larger communities, the seller must notify the association, which has 10 days after receiving notice to deliver the information. Reports cover governing documents, recent open board meeting minutes, assessments, unpaid charges, violations, finances, reserve information, and pending lawsuits. Condominium reports also cover insurance, certain repair problems buyers may pay for within six months, declarant control, and large corporate owners. Reports over 10 pages may be summarized, but buyers can request the full report, due within 10 days; buyers sign an acknowledgment at closing, and reports identify fees when multiple associations govern the property. Associations may rely in good faith on records or other information without independently checking it.
