Courts check funding conflicts in group lawsuits

Beginning December 31, 2025, courts must consider lawsuit funding and related conflicts when deciding whether class representatives and their lawyers fairly represent the group. In multidistrict cases, courts must consider funding and conflicts when choosing lead lawyers and other case leaders.

Lawsuit funders cannot control cases

Beginning December 31, 2025, funders cannot control decisions about lawyers, experts, case strategy, or settlement; the parties and their lawyers keep control. Funders cannot pay lawyers, law firms, or licensed health care providers for referrals. Funding backed directly or indirectly by a foreign entity of concern is prohibited. Violations can count as unlawful practices under Arizona law, and agreements that break the law can be voided.

Lawsuit parties disclose funding deals

Beginning December 31, 2025, Arizona covers agreements that tie payment to a lawsuit’s outcome, including some portfolios of cases. It excludes personal or family advances, lawyers’ contingency fees and cost advances, insurance and indemnity payments, regular institutional loans, certain nonprofit funding, and medical receivables funding. Parties or their lawyers must disclose whether a funding agreement exists and name the funder within 30 days after a case begins, unless the court orders otherwise. They must disclose again when an agreement is added or changed, and parties can ask the court for more details or confidential review. Courts must decide sanctions for missing, evasive, or incomplete disclosures.
