Truck operators face new civil fines

The law replaces misdemeanor charges with civil fines for envelope-permit violations ($750) and certain interstate carrier-registration violations ($500). Knowingly refusing a required weighing or an officer’s directions after weighing brings a $250 fine. Minimum overweight fines range from $100 for 1,001–1,250 pounds over the limit to $1,400 for 4,751–5,000 pounds over; at 5,001 pounds or more, the minimum is $1,400 plus $100 for each additional 1,000 pounds. Other fine amounts are $200 for 1,251–1,500 pounds over, $300 for 1,501–2,000, $400 for 2,001–2,500, $500 for 2,501–3,000, $840 for 3,001–3,500, $980 for 3,501–4,000, $1,120 for 4,001–4,500, and $1,260 for 4,501–4,750 pounds over. For axle-only violations, certain refusals or remaining over the limit bring a civil penalty instead of possible criminal penalties; drivers who shift into compliance when no more than 2,500 pounds over are not cited or penalized. Refusing portable-scale weighing carries a separate minimum tied to the minimum fine for being more than 6,000 pounds overweight.

Large trucks get more room to turn

Drivers of vehicles or combinations at least 40 feet long or 10 feet wide may leave the turning lane as needed to make a right or left turn. They must use due care around other traffic and follow any turning directions marked by road signs or markers.

More vehicles fall under truck rules

Arizona uses actual vehicle weight as well as weight ratings to decide which vehicles fall under its commercial driver licensing rules. For intrastate motor-carrier rules, a vehicle or combination generally qualifies at 26,001 pounds or more, using the greater weight measure. This intrastate rule applies only when the vehicle is not exempt from the specified gross weight fees.
