Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Clearer release deadlines for jailed defendants

For online bonds, the six-hour release clock starts when payment is submitted or a power of attorney is electronically filed. Extraordinary circumstances and court-ordered electronic monitoring can change the deadline. Time limits do not apply when a court requires monitoring before release for public safety. After more than 24 hours awaiting monitoring following bond posting, sheriffs must bring defendants to court the next business day. Unpaid fees, costs, or surcharges cannot block release after bond is posted, including online; those debts are not erased.

Bond payers keep control of deposits

Courts must return someone else's cash bond deposit once the defendant has no remaining obligations under the bond. Courts cannot use that money to pay the defendant's court debts. A defendant's own deposit can pay those debts only with voluntary written consent, never required for release. Any unused balance must be returned. Other payers can deposit directly with the jail without using the defendant's name or inmate account; these protections also cover online bonds.

Online bond payments with fee limits

By October 1, 2025, Colorado jails must offer online posting for every bond available in person, including credit-card payment. Sheriffs must post instructions and give online payers the same notices, bond papers, and next court date. Online and in-person bond-processing fees cannot exceed $10; other transaction fees, including kiosk fees, are banned. A credit-card company's standard processing fee is allowed. When a third-party vendor handles credit-card bond payments, its processing fee cannot exceed 3.5%.
