Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Legal protection for school food-sharing staff

The law protects designated school employees and local education providers overseeing food or drinks redistributed from share tables. It shields them from civil liability and criminal prosecution over the items' nature, age, condition, or packaging. Protection excludes willful, wanton, or reckless conduct causing injury, including disregard of sanitation, health, or allergy-prevention rules.

School food-waste incentives get state review

The Colorado Circular Communities Enterprise must consider incentives for public-school composting or share-table programs when promoting a circular economy. It does not have to offer incentives, and schools are not guaranteed funding. The law relies on existing grant and assistance tools, without new taxes, fees, or appropriations.

Schools encouraged to share food safely

Colorado schools are encouraged, not required, to adopt policies for food sharing, composting, and waste prevention. Share tables collect whole food or drinks students leave uneaten for redistribution to students or donation to local nonprofits. Schools adopting and implementing policies must follow health, sanitation, and allergy-prevention rules; food brought from home cannot be redistributed. Staff supervising share tables or identifying, storing, handling, or serving redistributed items must complete safety training. Policies must address safe handling, student and parent communications, and designated staff training and compensation.
