2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Fewer lease charges after tenant death

When a Colorado lease ends early because the tenant died, clauses requiring preset damages or other early-ending penalties are unenforceable. Landlords also cannot enforce clauses requiring repayment of concessions or move-in discounts. After notice of death, clauses cannot demand future rent beyond the later of month-end or 10 business days after the home is vacated. These protections apply to leases entered into on or after the law's effective date, set at September 1, 2025. A referendum petition filed within 90 days after final adjournment delays that date until voter approval in November 2026 and the governor's declaration of the vote.

Landlords can reclaim homes after death

After a Colorado tenant dies, the landlord can reclaim the home without an eviction case or court order through either route. The estate's personal representative can notify the landlord that the home is surrendered. Alternatively, 30 days after death, the landlord can reclaim it if rent remains unpaid or substantially all the tenant's belongings are removed. These rules apply to leases entered into on or after the law's effective date, set at September 1, 2025. A referendum petition filed within 90 days after final adjournment delays that date until voter approval in November 2026 and the governor's declaration of the vote.
