2 provisions identified: 1 benefits, 1 costs, 0 mixed.
Counties, special districts, and school districts can negotiate payments or tax credits for new or expanded fixed or mobile broadband facilities. Providers must prove the area is unserved or underserved using FCC coverage maps available January 1 of the negotiation year. Each award is capped at that government's current-year property taxes on taxable real estate or business equipment at the facility. Awards must be nondiscriminatory, nonexclusive, competitively neutral, and proportional to investment, with similar terms for later awards. Counties must notify affected municipalities, special districts, and school districts; negotiating special or school districts must notify affected municipalities and counties.
Counties and special districts that pay annual broadband incentives can raise their property-tax levy to cover those costs. The added levy amount cannot exceed the total yearly incentive payments or credits. School districts do not get this levy-increase authority. Increases are optional, so any added cost for homeowners and other property taxpayers depends on local decisions.
