Easier ADU building for homeowners
Starting October 1, 2026, towns with zoning rules adopted under a special act must allow at least one accessory dwelling unit on each lot with a single-family home. Towns cannot set stricter height, landscaping, or design rules for these units than for single-family homes. Towns and utility providers also cannot require a separate utility connection or charge for an accessory unit, or treat it as a new home when setting connection or capacity charges. That charge rule has an exception when the unit is built with a new single-family home on the same lot.
More towns may face housing appeals
Starting October 1, 2026, the state leaves out accessory dwelling units built or permitted after January 1, 2022, when counting homes toward a town’s 10% affordable-housing threshold. One category of accessory units remains counted. This change can affect whether housing applicants can use the affordable-housing appeals process; it does not provide a direct payment.
