Faster re-notice and refunds for overcharges

If a landlord re-notices a rent increase that takes effect on or after July 1, 2023, it can give less than 30 days’ notice only if the new increase is smaller. If you paid more than the legal rent under an earlier notice, the landlord must repay you within 30 days after the overpayment or by August 1, 2023, whichever is later.

Rent-stabilized homes 6% yearly cap

For rent-stabilized units, yearly increases taking effect July 1, 2023 through April 30, 2025 are capped. The cap equals the official adjustment plus 2 percentage points, but never more than 6% in a year. Over May 1, 2023 to April 30, 2025, total increases cannot exceed the April 30, 2023 legal rent by more than 12% for other tenants. The same two-year cap is 8% for seniors, disabled tenants, or units leased by an HCBS provider.

Stronger caps for seniors and disabled

If a unit is occupied by someone 65 or older or a person with a disability, yearly increases are tightly limited. For increases taking effect July 1, 2023 through April 30, 2025, the increase must be the smallest of: the official adjustment, the latest Social Security COLA, or 4%. Total increases over that two-year period are capped at 8%. For units leased or co-leased by a home and community-based services provider, the yearly cap is the smaller of 4% or the official adjustment, with an 8% two-year cap. These rules apply regardless of income.

When these temporary rent caps apply

The law takes effect January 12, 2025 after mayoral approval and a 30-day congressional review. It expires 225 days later, on August 25, 2025. The annual and two-year caps apply to increases taking effect July 1, 2023 through April 30, 2025, and totals are measured within that period.
