Chance to waive five-year wait for D.C. pardons

As a D.C. clemency applicant, you can ask the Clemency Board to waive the five-year waiting rule. You must send a written request, and the Board must have notice from the Office of the Pardon Attorney that DOJ or the President granted you a waiver under DOJ Manual § 9-140.112. The Board can deny the waiver even with that notice. The Board cannot grant a waiver if you are on probation, parole, or supervised release. The Board may ask for more information or meet with you. It must send you a written decision, and your clemency case is put on hold until the waiver decision is made.

Temporary 90-day effect for waiver rule

This emergency law takes effect after the Mayor approves it, or after a Council veto override. It remains in effect for no longer than 90 days. During that time, the new five-year waiver process is available.
