Faster, simpler abbreviated probate process

The law streamlines “abbreviated probate” to admit a will or confirm no will and appoint a personal representative. You start it by filing a petition, and the court can begin without the usual prior notice. The court or Register appoints a personal representative right away, and it is unsupervised by default unless the order says otherwise. To admit a will, the court can presume it was properly signed, or accept a sworn statement from someone with personal knowledge. The Register can require more sworn proof and send the case to a judge, which can add time and costs.

Emergency law in effect for 90 days

The law takes effect once the Mayor approves it or the Council overrides a veto. It remains in force for up to 90 days. The new probate rules are available right away during that period.

Probate changes apply after Mar. 21, 2025

The 2024 probate reforms apply only to estates of people who died on or after March 21, 2025. Estates for people who died earlier follow the prior rules.

One probate rule subsection repealed

The law repeals D.C. Code § 20-361(a)(4). The summary here does not state what that subsection did. Effects depend on the content of the repealed rule and may change steps for some estates.
