The law sets curfew from 11:00 p.m. to 6:00 a.m. every day. It now applies to anyone under 18, including 17-year-olds. Curfew also includes any posted extra hours set by the Mayor or the Chief of Police. As an emergency law, it takes effect after approval and lasts no more than 90 days.
The Mayor can add curfew hours for the whole city or certain areas. The Chief of Police can set extended-curfew zones. Added hours cannot start before 8:00 p.m. or go past 6:00 a.m. Each order or zone lasts up to 4 days and can be extended by later orders up to 30 days. Orders usually take effect at least 24 hours after they are issued unless there is an emergency. Notices are posted online, and MPD posts signs in the area. Mayor orders do not apply to groups of more than 8 people. Chief designations do not apply to groups of 8 or fewer and can be based on credible intel about 9 or more juveniles gathering. Local ANCs, BIDs, and Main Streets can petition for a zone, but the Chief decides.
Before taking action, officers must give a verbal warning that says the group is breaking curfew, that arrest can follow, and how to leave to avoid arrest. In curfew zones and during extended hours, MPD must give at least two clear warnings if there is no imminent danger, or one warning if there is. Officers must allow reasonable time to disperse. They must record these steps on body-worn cameras.
