The law caps the annual public-space rent for a streatery permit at $15 per square foot. Your maximum yearly fee equals your permitted square feet times $15. Agencies can charge less, but not more. The cap applies only to the public-space part of the permit.
The law requires that selected roadways include the 2000-2400 blocks of 18th Street NW in Ward 1. It also requires recommendations on how to designate and design curbside space for streateries, parklets, and similar uses. This directs planning to that area and sets clearer curbside guidance.
The Public Space Committee can waive some streatery rules if it does not create an undue risk. Waivers can cover spacing from curb cuts, driveways, alleys, and trees, the 42-inch height limit, and seating caps. If you get a waiver, you must reapply to renew your permit every two years through the Committee. District agencies do not enforce streatery rules before January 15, 2026.
The law takes effect after the Mayor approves it (or a veto is overridden) and after a 30-day congressional review. The law expires 225 days after it starts. All changes in this act stop on that date.
