Beginning July 1, 2026, Florida school districts cannot require employees to sign nondisclosure or confidentiality agreements. Districts also cannot offer incentives for signing them. They cannot use job conditions to get around this ban.
Beginning July 1, 2026, Florida law defines grounds that count as good cause for rejecting a school district employee nominee. These include fabricated or materially exaggerated credentials or background, and failure to meet the job’s minimum requirements. They also include an educator certificate revoked by another state.
Beginning July 1, 2026, Florida school board members can comment publicly on district business during or outside meetings. This right excludes student and employee disciplinary hearings covered by state law, and other legally barred matters. Districts must keep board meeting documents as public records with each meeting’s minutes. This includes agenda attachments such as vendor contracts and budget documents.
Beginning July 1, 2026, Florida school board members get free, timely access to district records needed for their duties. Requests tied to matters at publicly noticed board meetings must be filled within 10 business days. Records given to one member must be offered to all members, and confidential records remain protected by law. Members can consult the district’s chief financial officer and request reasonable access to budget line items and financial transaction details. Members can also request legally accessible information from staff with an administrator’s permission, which cannot be unreasonably withheld.
