L.E. gets relief with claim limits

Effective upon becoming law, the law provides a one-time $3.8 million from Florida’s General Revenue Fund for injuries caused by the Department of Children and Families’ negligence. The state’s Chief Financial Officer must pay the money to an existing irrevocable trust solely for L.E.’s benefit. Together with $200,000 already paid, this $4 million is the sole compensation for all present and future claims against the department arising from these events. Attorney fees for this claim cannot exceed 25% of the new $3.8 million award, or $950,000. Related claims against the subcontracted agency remain pending.
