More Privacy, Less Public Financial Oversight

Florida's Office of Financial Regulation keeps covered money-services investigation and examination records, including customer complaints, confidential while cases are active. Coverage includes virtual currency kiosks, qualified payment stablecoin issuers, and money transmitters holding gold or silver coins for customers. Trade secrets and personal financial information stay protected afterward. Other records stay exempt only where release threatens another active investigation or exposes personal financial details, confidential sources, or investigative methods. Covered investigation exemptions and financial-institution record protections expire October 2, 2031, unless lawmakers review and reenact them. The money-services expansion starts with HB 175, SB 198, or similar legislation enacted in the same session or extension, or sections 1–15 of chapter 2025-100. The financial-institution review change starts with HB 175 or similar legislation enacted in that session or extension, or those chapter provisions.

Payment Record Privacy Faces Expiration

Covered Florida payment records keep licensees, payors, payees, and people conducting transactions confidential, limiting public access. Florida's deferred presentment database also protects identities of check writers and providers of these payday loans. These exemptions expire October 2, 2031, unless lawmakers review and reenact them under the Open Government Sunset Review Act. The review changes start when sections 1–15 of chapter 2025-100 take effect.
