Owners get cleanup relief with strict exclusions

Beginning July 1, 2026, Florida’s petroleum cleanup participation and liability insurance programs cannot charge deductibles, copayments, or monetary caps. The Inland Protection Trust Fund pays covered costs without seeking repayment, and this relief has no expiration date. Cleanup participation covers eligible petroleum-storage spills before January 1, 1995; continued funding requires yearly approval and is not guaranteed. Relief excludes sites that deny department access and costs incurred before the program’s grace period. Gross negligence, intentional record falsification to hide a serious spill, or intentional system damage makes a site ineligible for the incentive. Its owner owes all costs from petroleum-storage spills at that site.

Tank owners get capped fuel-damage repair aid

Beginning July 1, 2026, the department can spend up to $10 million each fiscal year from the Inland Protection Trust Fund. This pays labor and equipment costs to repair or replace petroleum storage systems damaged by ethanol or biodiesel blends, or prevent damage. Payments exclude proposal, application, documentation, and certified public accountant costs, plus amounts above department approval or outside substantial purchase-order compliance. The program does not pay again for tanks, piping, or related equipment already repaired or replaced with its funds. Facilities must resolve storage-tank rule violations before payment, and damage from causes other than ethanol or biodiesel fuel storage is excluded.
