Owners bear risks for early septic construction

Property owners or applicants assume legal, financial, and safety liabilities when onsite sewage-system construction starts before its permit is issued. This responsibility covers liabilities arising from that construction.

Fewer septic permit hurdles for homeowners

For single-family homes needing onsite sewage systems, local governments cannot require the system permit before issuing building or plumbing permits. Owners or builders must show proof of submitting the system permit application when applying for those permits. Florida's Department of Environmental Protection cannot require owners, developers, or subdividers to complete or submit subdivision analyses before applying. Beginning July 1, 2026, new department rules on system use or installation do not apply to applications submitted within 90 days after adoption.
