The law makes Commercial Vehicle Enforcement members sworn, trained, and certified officers. They can enforce commercial vehicle laws anywhere in Georgia. The commissioner can allow officers to use trained dogs to find drugs while on duty. If a dog gives probable cause, officers can enforce state drug laws and seize contraband. After any seizure, the department must notify local police and the district attorney right away.
The law creates weight inspector jobs at fixed highway scales. Inspectors work only at these scale sites and get the same training as certified officers. They can enforce noncriminal rules on weight, size, load, and registration and issue civil penalties. Inspectors can hold a truck at the scale for a critical safety defect, a criminal-law violation, or a federal out-of-service order. A certified officer must respond to finish inspections or file charges. A certified peace officer must also be the on-duty supervisor when inspectors are working.
