Georgia bans adversary-owned firms from contracts

State agencies require every bidder to certify they are not a “scrutinized company.” Scrutinized companies cannot bid directly or through a third-party seller. The ban covers office gear and services such as computers, printers, connecting cables, and interoperable video meetings. If the Department of Administrative Services finds a false certification, the agency must end the contract. The company must pay the larger of $250,000 or six times the contract’s total value. The company also becomes ineligible to bid on future state contracts.

Who counts as a 'scrutinized company'

The law defines key terms for state contracting. A “scrutinized company” includes any firm owned or operated by the Government of China or a foreign country of concern, or any firm in which such a government has an ownership stake. A “foreign country of concern” is one designated by the U.S. Secretary of Commerce. These definitions decide which vendors face the state’s bidding ban and certification rules.
