New limits on mortgage trigger solicitations

The law defines a “mortgage trigger lead” as a credit report pulled after you apply for a mortgage. Reports from your original lender or your loan servicer are not trigger leads. Companies using trigger leads must say in the first contact that they are not your original lender and must follow prescreen rules, including a firm offer of credit. They cannot use data for people who opted out of prescreened offers or are on the federal do-not-call list. They also cannot bait-and-switch by offering terms they plan to worsen later.

Mortgage lenders and brokers face licensing enforcement for unfair or deceptive trigger-lead solicitations banned by the law. These violations are unlawful under the Fair Business Practices Act and can lead to penalties under state mortgage licensing rules.
