No-fee option and clear notice

A convenience fee cannot be charged unless a no‑fee way to pay is offered. You must be able to pay by cash, check, money order, or an electronic option with no fee. If a fee is charged, the lender or merchant must tell you the dollar amount first, say it is nonrefundable, and say it is for electronic payment.

Convenience fees for electronic payments allowed

Lenders and merchants in certain loans and sales can charge a nonrefundable fee when you pay electronically. Electronic payment includes credit and debit cards, electronic funds transfer, e‑checks, and similar methods. The fee must equal their processing cost paid to a third party (including an affiliated processor), or they may instead charge no more than the greater of their average cost for that payment type or $5.00. The fee is on top of other charges and is not treated as interest or a finance charge under Georgia law. This applies to state‑regulated loans and installment loans, retail and home‑solicitation sales, car financing, and insurance premium finance agreements, and must follow card or bank network rules.
