Limits on ride-share company lawsuits

The law shields ride‑share network companies from most claims for harm caused by a driver’s personal car. The shield applies only if the company was not negligent or criminal, follows its legal duties, and runs a driver background check at least every two years as in Code Section 40‑5‑39. It also says a ride‑share app or website is a service, not a product, which reduces product‑liability claims.

Drivers: updated motor carrier exclusions

The law narrows who counts as a “motor carrier” in Georgia. It excludes vehicles used only for school children or teachers, taxicabs in city limits, limousines, hotel shuttles, certain nonprofit vans, government vehicles, small-capacity medical transport for seniors or people with disabilities, and ambulances. If your vehicle fits an exclusion, you are not regulated as a motor carrier. For driver‑owned commuter vans in the nonprofit or corporate vanpool exception that carry more than nine passengers and run for profit on trips to or from work, you must carry at least $100,000 per person, $300,000 per accident, and $50,000 in property damage liability insurance.
