The law gives captive insurance companies broader authority to write insurance and reinsurance that the Commissioner finds reasonable, as allowed by their formation documents. It covers casualty (with accident and sickness generally excluded), marine and transportation, property, and surety lines. Pure captive insurance companies may also write accident and sickness insurance. The law expands who counts as a controlled unaffiliated business, allowing certain outside partners and approved reinsurance deals with other captives, subject to the Commissioner’s approval.
The law sets new rules for limited purpose subsidiaries that handle reinsurance. These subsidiaries must be wholly owned by the organizing domestic reinsurer or by one or more sponsors. They can reinsure only the insurance lines the organizer or a sponsor is authorized to write, and only the organizer’s own risks. Subsidiaries that hold a certificate of authority may also use alternative forms of financing.
