If you lease from the Authority, it sets your rent and fees. Charges can start before the project is finished. Rents can cover operating costs, reserves, and bond payments. Leases can require you to operate, maintain, and repair the space and to indemnify the Authority. The Authority may assign your rent payments to a trustee or paying agent.
The law creates the City of Doraville Building and Public Facilities Authority. A five‑member board runs it; no more than two can be city council members. Projects must be inside Doraville. All lawsuits about this law or the Authority go to DeKalb County Superior Court. The Authority and its staff have the same tort immunity as the City. Authority property cannot be seized by creditors. If the Authority dissolves after paying all bonds, its property goes to the City. Any conflicting older laws are repealed.
The Authority does not pay state or local taxes on its property, income, rents, or fees, as allowed by general law. Sales and use tax still applies to property it buys.
The Authority can borrow money and issue revenue bonds to fund projects. Bonds are paid only from Authority rents and revenues, not state or city taxes or credit. The Authority can secure bonds with a trust, pledge project income, and set up sinking funds. It can also refinance outstanding bonds. Bond money and pledged revenues are held as trust funds for bondholders. Bonds go through a court validation process that names all parties whose contracts back them, and the clerk publishes notice. The law protects bondholder rights while bonds are outstanding.
