If you become totally and permanently disabled, you can get a disability pension. With at least 4 years of service, you get 50% of the maximum retirement benefit. With at least 10 years, you get two‑thirds (66.66%) of the maximum. The applicable maximum depends on when you first joined the system.
For members who first join on or after July 1, 2026, years served as a superior court judge do not count in your pension if you retire before age 65. At age 65 or older, all superior court service counts. You still vest after 10 years and cannot get benefits before age 60.
You vest after 10 years of service and cannot draw benefits before age 60. The base pension equals 66.66% of salary plus 1% for each year over 16, up to 24 years counted. You may retire at 60 with at least 10 years, but the monthly check is reduced by a factor of years worked divided by 16. The early‑retirement base used depends on when you first joined the system. If you move between covered positions, you keep your membership and prior service credit.
In certain single‑county circuits with an unincorporated county site and permanent satellite courthouses, the county must add a supplement to a retired district attorney’s pension. The supplement equals your benefit percentage times the larger of the county supplement paid to the current DA when you start benefits, or the supplement you received on your last day. This supplement does not go to a spouse or survivor.
