Interest on the Authority’s bonds is exempt from Georgia state tax. Property owned by the Authority is exempt from local property (ad valorem) taxes and other local assessments on its activities and income, including rents. Sales and use tax still applies to Authority purchases.
The law creates the Public Facilities Authority of the City of Fairburn. People who sit on the Development Authority board also serve on this board, with expense reimbursement but no pay. The main office is in Fairburn and lawsuits must be filed in Fulton County. The Authority works inside city limits, cannot levy taxes, and cannot use eminent domain. It and its staff have the same legal immunity as the city. If it dissolves after paying all debts and ending contracts, its property and money go to public bodies.
The Authority can sell revenue bonds and other obligations to build or refinance projects. These debts are paid only from pledged project revenues and are not debts of the state or city. Money the Authority receives is held in trust and used as the bond documents require. Revenue bonds are validated in Fulton County Superior Court. The Authority’s property is shielded from levy and sale, except if it granted a mortgage or similar security. Its bond offerings are not subject to Georgia state securities registration.
The Authority can own, lease, or run local projects and hire private operators. It sets and collects rates, fees, tolls, rents, and other charges for services and facilities it provides. This can change what you pay for things like utilities, parking, or recreation at Authority sites. Prices depend on the project and contracts the Authority signs.
