More used car sellers need licenses

The law expands who counts as a used vehicle dealer. Wholesalers, brokers, and some independent leasing agencies are now treated as dealers. Selling five or more used vehicles in a calendar year is taken as being in the business. If you are covered, you must get a dealer license and follow dealer rules.

Stronger penalties and restitution in dealer cases

The board can fine a dealer up to $500 per violation. You have 30 days to pay or ask in writing for a hearing. If you do neither, your license is suspended until the hearing. The board, its division, the Attorney General, or local prosecutors can sue for civil penalties and restitution. Courts order restitution to be paid directly to the consumer by the defendant. If a case is brought for a county or city, half of any penalty money goes to that local treasury.

Stricter business and inspection rules for dealers

Licensed dealers must keep an established business location with a working phone in the licensee’s name. A permanent sign is required, and the board sets the size and standards. By holding a license, you consent to inspections of records, vehicles, and parts at your main and extra business sites during reasonable business hours. The board can require extra records about how you run the business and your staff.
