How the CID board is chosen and removed

The board has five members: one picked by the city council, one picked by the city manager, and three elected by district electors. The council can expand the board to seven members, with the two extra seats elected. Elected members serve 4‑year terms; appointed members serve at the pleasure of who appointed them. Elected members must remain electors; if they stop qualifying, their seat is vacant that day. Any board member can face a recall election called by the city council or by a petition signed by one‑third of district electors. Board members are not paid, but they are reimbursed for actual expenses.

Conflicting CID rules repealed

Any laws that conflict with this Act are repealed. The Act’s rules control if there is a conflict.

When and how CID elections run

The first caucus to elect board members is held within 60 days after the city council sets the time and place. Notice must run in the Effingham County legal organ once a week for 4 weeks. After that, a caucus is held each year no later than 60 days after the last day to file ad valorem property tax returns in Effingham County. If a seat opens, the board calls a special election within 60 days and holds it within 60 days of the call, unless the vacancy is within 180 days of the next regular election. State election laws in Chapters 2 and 4 of Title 21 do not apply; the board may set election bylaws that do not conflict with this Act.

Who can vote in the CID

Owners of real property in the Rincon community improvement district are the electors. Your ownership must appear on the most recent Effingham County ad valorem real property tax records. A corporation may vote through one officer or director. A trust may vote through one trustee. Any owner may name one representative by filing a written form with the city attorney at least 8 days before the election. Each owner gets only one vote, even if they own multiple parcels. Co‑owners of a single parcel share one vote and must name one person in writing to cast it.
