Beginning January 1, 2026, the Department prints an issue date on every decision. That date starts the clock. You must ask for reconsideration or file an appeal within 15 days of the printed issue date on a determination. If you get a hearing officer’s decision, you must start any further appeal within 15 days of its issue date. The Commissioner can issue a redetermination for good cause before a decision becomes final. Electronic delivery counts only if you agreed to it.
Beginning January 1, 2026, a board of review decision is final 15 days after it is mailed. The printed issue date appears on the decision. The board can reopen its decision on its own within those 15 days. If the board plans to reconsider, court review is paused until a final decision issues. You can go to court only after you finish all administrative steps. In court, the Commissioner is a party and the Attorney General represents the Department.
Beginning January 1, 2026, the Commissioner can make rules to waive, alter, extend, or set aside appeal time limits. Any rule must follow due process and the chapter’s purpose. This flexibility can give you more time in some cases, but deadlines can also change.
