The law expands what counts as a project for the Newton County Public Facilities Authority. It now covers buildings, facilities, and equipment for the county, its departments, the school district, and cities in the county. The Authority can sign contracts, leases, and installment sale agreements to buy, build, run, sell, or finance these projects. Newton County, the school district, cities, and private parties can enter these deals with the Authority.
If the Authority is dissolved, its assets become Newton County property by default. A project agreement can set a different owner.
The Authority can borrow money and issue revenue bonds or other obligations to pay project costs or refund old debt. Principal and interest are paid only from pledged revenues or property, and the bonds must say they are not debts of the county, school system, cities, or the state. The law does not require the county or state to levy taxes or make appropriations to pay the bonds. Bond maturities cannot be longer than 40 years. For school district or city projects, the County Board of Commissioners must approve any bond issue, and local governments may sign contracts to cover operating costs and debt service.
