The law ends subminimum pay for workers with disabilities under federal 214(c) certificates. It takes effect July 1, 2025. For certificates issued on or before July 1, 2025, employers must pay at least half of the federal minimum wage from July 1, 2026 through June 30, 2027. Starting July 1, 2027, employers cannot use 214(c) certificates to pay below the federal minimum wage.
Beginning July 1, 2025, the labor commissioner can grant exemptions that let some employers pay below Georgia’s minimum wage. Exemptions apply to certain categories when public policy supports hiring people who cannot compete in the labor market, including persons with disabilities. The commissioner investigates each request and keeps a public list with the reasons and records. This can mean more job options, but at lower pay for those jobs.
