Effective upon approval, the law expands Hawaii’s Attorney General pilot to clear more drug arrest records without applications or fees. It adds arrests involving a single charge under HRS § 712-1249 for possessing any amount of a Schedule V substance. The arrest must predate January 11, 2020, in a county with more than 200,000 but fewer than 500,000 people. The case must have ended without a conviction, and no other law can bar expungement. The pilot ends October 1, 2025. Hawaii’s criminal justice data center processes the orders using existing funding and resources, with no new appropriation. The Attorney General must report progress and lessons to the Legislature to help guide future statewide expungement laws.
