Hawaii property owners can skip special management area minor and use permits for qualifying disaster rebuilding. The exemption covers lawfully built structures damaged or destroyed in a governor-declared emergency or federally declared disaster. Work must begin within six years of the disaster proclamation. The parcel cannot be on the shoreline or affected by waves, storm surges, high tide, or shoreline erosion. The rebuilt structure must have a similar original footprint or overall dimensions, as existing or permitted, and meet floodplain rules. Officials retain authority to require review when work may have cumulative impacts or significant environmental or ecological effects. The law took effect upon approval and ends July 1, 2028, when the prior statutory definition returns.
