County liquor commissions can request criminal-history checks of liquor-license applicants. When a check is conducted, applicants must disclose convictions for crimes that suggest they may be unfit for a license, unless the conviction judgment has been vacated. Applicants must provide their name, Social Security number, birth date, and gender; the information can be used only for the check. Officers and directors of publicly traded companies, and of entities solely owned by them, are exempt from checks and fingerprints when they are not primary decision-makers on liquor sales or purchases. In counties with fewer than 500,000 people, commissions cannot request fingerprints from nonprofit officers, directors, or board members applying for a liquor license.
