4 provisions identified: 1 benefits, 2 costs, 1 mixed.
Beginning July 1, 2025, Hawaii’s Department of Health runs a program to purchase and provide immunizations. The law transfers and appropriates $934,000 for fiscal year 2025–2026, or as much as needed, for vaccine purchases and program costs. The program fund keeps money that would otherwise go to the state through a 5% service deduction. Providers cannot bill anyone for a vaccine supplied at no cost by the State, though provider payment for giving the vaccine is unchanged.
Beginning July 1, 2025, the law bars liability claims against the Hawaii Department of Health, its contractors, and its employees for actions or omissions while running the immunization program. This limit does not cover assessed entities’ liabilities under the law.
Beginning July 1, 2025, assessed entities must report covered people and pay monthly assessments. The director sets rates based on covered lives and fund needs; the law gives no fixed rate. The fund can hold reserves of up to 10% of the prior fiscal year’s program costs, plus unanticipated costs. Unpaid assessments gain 1% interest each month, compounded monthly. The director may impose one interim assessment per year, due within 45 days of notice; more are allowed during a declared public health emergency. Entities must answer audit requests within 10 business days, and violations not fixed within 30 days of written notice can bring fines of up to $1,000 per offense, with each day counting separately.
Beginning July 1, 2025, Hawaii providers must report immunizations to the state registry when the vaccines come from federal or state programs. The Department of Health decides what information providers must report. The registry supports disease prevention and vaccine tracking.
